La notice Claims informe le titulaire du nom de domaine qu'une société ou un particulier revendique des droits de marque sur le terme en cours d'enregistrement. Cependant, la notice Claims n’empêche pas le titulaire d’enregistrer le nom de domaine.
La section ci-dessous décrit ce qu'est la notice claims, qui reçoit la notice et pourquoi, ce que le destinataire de la notice peut faire lorsqu'il reçoit un avis et quelles en sont les implications.
1. Titulaires de noms de domaine dans de nouveaux domaines génériques de premier niveau (New gTLDs) peuvent recevoir une « Claims Notice » lorsqu’ils tentent d’enregistrer un nom de domaine.
En tant que titulaire potentiel, vous pouvez voir une notice Claims lorsque vous cherchez à enregistrer un nom de domaine si votre nom de domaine correspond à une marque enregistrée dans le TMCH.
La notice Claims explique qu'une entreprise ou un particulier revendique des droits de marque sur le terme que vous essayez d'enregistrer, mais cela ne signifie pas nécessairement que vous ne pouvez pas enregistrer et utiliser le nom de domaine. La notice Claims comprend le nom de l'entité qui fait la réclamation, la juridiction, la classe de marchandises et les coordonnées de l'entité.
Après un examen attentif de la notice, vous pouvez choisir de poursuivre ou non l'enregistrement de votre nom de domaine.
Si vous enregistrez le nom de domaine, le titulaire de la marque répertorié sur la notice Claims recevra une notification de l'enregistrement de votre nom de domaine.
Veuillez noter qu'il existe une différence entre la notice Claims et les notifications Claims :
Notice Claims :
- A Claims Avertissement est affichée à un titulaire de nom de domaine lorsqu'ils tentent d'enregistrer un nom de domaine qui correspond à une marque enregistrée dans le TMCH.
- Il prévient le titulaire que le domaine qu'il tente d'enregistrer correspond à un enregistrement de marque dans le Clearinghouse.
- Le déclarant peut toujours continuer avec l'enregistrement mais doit accuser réception de l'avis.
- La notice Claims est fournie par la Trademark Database (TMDB).
Claims Notification :
- A Claims Notification est envoyée au titulaire de la marque si un nom de domaine correspondant à leur marque est enregistré pendant la période de réclamation.
- Cette notification informe le propriétaire de la marque que quelqu'un a enregistré un nom de domaine potentiellement contrefaisant.
- La notification Claims est fournie par le Trademark Clearinghouse (TMCH).
Essentiellement, la différence entre la notice Claims et la notification Claims est à quel parti l'information est envoyée.
2. Raisons pour lesquelles vous pourriez vouloir poursuivre l'enregistrement de votre nom de domaine.
L’enregistrement de votre nom de domaine ne doit pas porter atteinte aux droits du titulaire de la marque, même s’il existe une correspondance totale ou partielle avec le nom de domaine.
Des exemples de gTLD les noms de domaine qui ne peuvent pas porter atteinte aux droits du titulaire de la marque comprennent :
- Limites géographiques :
Exemple : une marque est enregistrée en République de Corée (ROK), mais pas dans un pays d'Amérique latine. Si le nom de domaine est destiné à être utilisé en Amérique latine et ne cible pas la Corée du Sud, il ne peut pas enfreindre les droits de marque en Corée du Sud.
- Biens ou services différents :
Exemple : si une marque est enregistrée pour une catégorie spécifique de produits (par exemple, des appareils électroniques), elle ne couvre pas nécessairement une catégorie différente (par exemple, des vêtements). Si vous utilisez votre nom de domaine pour différents produits et services non couverts par la marque, cela ne sera peut-être pas considéré comme une transgression.
- Expressions génériques dans les marques mixtes :
Exemple : Dans le cas d’expressions génériques enregistrées comme marques dans des marques mixtes (avec un logo), la protection s’applique à la marque mixte dans son ensemble et non à l’expression (nom de domaine à demander) prise isolément. Par exemple, une marque mixte qui inclut un terme générique comme « crème glacée » dans un logo n’empêche pas nécessairement l’enregistrement du nom de domaine « icecream.com » si le nom de domaine n’utilise pas le dessin du logo.
- Utilisation non commerciale :
Exemple : un nom de domaine enregistré pour un usage personnel, éducatif ou non commercial qui correspond à une marque déposée à des fins commerciales. S'il n'y a aucune intention de concurrence commerciale, l'utilisation du nom de domaine ne peut pas être considérée comme une contrefaçon. Si je souhaite enregistrer mon nom de famille comme nom de domaine pour un site Web destiné à expliquer l'histoire de ma famille, aucune préférence ne doit être accordée à une marque partageant le même mot.
3. Éléments à prendre en compte avant de procéder à l’enregistrement de votre nom de domaine.
Si votre nom de domaine correspond à un enregistrement de marque dans le registre de l'ICANN Trademark Clearinghouse, le titulaire de la marque recevra une notification dès que vous aurez terminé l'enregistrement de votre nom de domaine.
Le titulaire de la marque peut alors évaluer votre nouvel enregistrement et l'utilisation du nom de domaine, et déterminer si cela porte atteinte à sa marque. Si le titulaire de la marque estime que le nom de domaine a été enregistré et est utilisé de mauvaise foi, il peut chercher à transférer le nom de domaine à son nom via la Politique uniforme de résolution des litiges relatifs aux noms de domained'ICANN, ou chercher à suspendre le nom de domaine via le Système de suspension rapide uniforme (URS) d'ICANN.
Si le titulaire de la marque estime qu'il y a violation de sa marque, il peut intenter un autre type d'action en justice, y compris une action en justice dans la juridiction de l'enregistrement de sa marque.
