The Qualified Launch Program is intended to provide a mechanism for Registry Operators to
register a limited number of names to third parties to promote their TLDs prior to the Sunrise
Period, while maintaining safeguards against intellectual property infringement.
According to the QLP Addendum, if a domain name matches a label in the Trademark
Clearinghouse (TMCH), the domain name may be registered to a Sunrise-Eligible Rights Holder,
as defined in the TMCH Requirements. If a domain name does not match a label in the Trademark
Clearinghouse, the domain name may be registered in a Qualified Launch Program to any third
party.

The Trademark Clearinghouse can forward NORN (sunrise and claims) and ongoing notifications directly to the e-mail address of the holder in the mark record.This service can be activated when submitting the mark record or later on by navigating to the mark record via the Mark tab and activating the service in the services section.

To activate the service a one time fee of $10 will be charged to your account, the service can be deactivated or re-activated without added cost, for the duration that the mark record is protected within the TMCH. The notification will be sent to the holder e-mail address at the same time the notifications are sent to the Trademark Agent e-mail address, but will be filtered based on the mark name for which the service was activated.

Please note that this service can not be activated with accounts that have enabled the API, you will first need to disable the API via the "My Account" interface.

Ongoing notifications will be sent out when a domain name is activated. Activated means that the domain name has been added to the zone file and that nameservers have been linked to the domain name, however this does not mean that the domain name is being used as such.

You will receive “watermark” messages, if your pre-paid amount has gone below $5000 and again if your pre-paid amount has gone below $1000.

In order to set up additional e-mail address, the new e-mail addresses must be configured for your account.

After navigating to your account settings, click on "Configure additional email addresses".

You will be able to add 6 additional email addresses, and link 1 or more of the following notification types to those email addresses:

Notifications:

  • Sunrise notifications;
  • Claims notifications;
  • Ongoing notifications.

Status Changes:

  • A mark record has been assigned status verified;
  • A mark record has been assigned status incorrect;,
  • A mark record has been assigned status invalid;
  • A mark record has been assigned status invalidbecause it has been on status incorrect for too long;
  • Manual status change of a mark record;
  • A mark record has been assigned status deactivated;
  • A mark records has expired;
  • A mark record has been transferred;
  • A UDRP or Court Case has changed status;
  • A Proof Of Use has expired;
  • A Proof Of Use has been verified;
  • A Proof Of Use has been invalidated;
  • A Proof Of Use has been assigned status incorrect.

Financial notifications:

  • Your pre payment amount has gone below watermark level (agent only);

Expiry notifications:

  • Your mark record will expire soon;
  • Your trademark will expire soon;
  • Your Proof Of Use will expire soon.

SMD notifications:

  • An SMD has been created for a mark record;
  • An SMD has been regenerated for a mark record;
  • An SMD has been revoked for a mark record.

You should then determine what the most appropriate steps are to take depending on your intellectual property strategy. You can, for instance, contact your lawyer in order to determine if the mentioned website is indeed infringing your rights and if so, whether you should file a UDRP case or a URS case. No, potential domain name registrants will not receive a claims notice when attempting to register a domain name that matches the name of a trademark recorded in the Clearinghouse during the Ongoing Notifications period. That warning notice will only be sent out during the original Trademark Claims Period. However, you as a trademark holder will be notified when the domain name is registered in a New gTLD.

This service will be made available as from the April 2014, when the first gTLD ends its mandatory claims services of 90 days.

Whenever someone has activated a domain name in a new gTLD that exactly matches a term that is recorded in the Trademark Clearinghouse, the trademark holder will receive an e-mail informing him of this domain name activation, so he can take the necessary steps. It comes at no additional cost. The service is non-mandatory, leaving each trademark holder or agent to decide whether they wish to activate it. It lasts during the duration of their trademark record registration with the Trademark Clearinghouse.

When a domain name matching your trademark is registered during sunrise, claims or ongoing notifications periods a notification e-mail is sent to the e-mail address linked to your account.

The Trademark Holders or Trademark Agents will only be notified when a another party registers a domain name matching the name of their trademark during a sunrise period or a trademark claims period provided that they opted for sunrise services or trademark claims services.

Notifications are be sent by to the email address you provide in the contracting information part when registering with the Clearinghouse.

Yes, once the account has been created and approved. An agent can list multiple e-mail addresses that can receive different kinds of notifications. You can find this option under "My Profile/My account.

Yes, as a Trademark Agent you will be receiving all the notifications on behalf of your Trademark Holder(s). The Trademark Holders acting through a Trademark Agent will not receive notifications directly from the Clearinghouse.

If you record for three (3) or five (5) years, you will only receive a notification in the event the verification agents of the Clearinghouse require some clarifications with regards to your trademark record. All trademark records will be verified on an annual basis.
